Terms of License
Definitions
I, me: Nicholas Moore, a sole trader in the United Kingdom doing business using the trading name Pilotmoon Software.
Product: The PopClip software application. The scope of the product does not include any extensions (see Extensions below).
You: A licensed individual or organization, or an individual using the free trial.
Authorized reseller: A business authorized by me to sell license keys to you (see Appendix A).
App Store: Apple's Mac App Store.
Free trial
Where the product has a free trial mode, I grant you the right to use the product free of charge for the period of the trial. The trial mode may include purchase reminders and limitations on usage.
I encourage you to make use of the free trial before buying, to find out if the product is suitable for your needs.
License purchases
License keys may only be purchased through an authorized reseller.
License grant
In consideration of the purchase fee paid by you to the reseller, I grant you a non-exclusive, non-transferable, non-sublicensable, perpetual (subject to the update policy), irrevocable (subject to the revocation provisions), royalty-free right and license to use the product, subject to these terms and the reseller's terms.
Registration and activation
The license key will be registered to a named user and email address at the time of purchase.
After purchase, you will receive a license key and instructions on how to use it to activate the product. Activating the product removes all trial restrictions and purchase reminders.
Change of registered details
To change the registered name and/or email address after purchase, contact support.
Allowed numbers of users and computers
License keys may be personal or multi-user licenses:
Personal license: A personal license key is for use by only one registered user on up to 5 computers that the registered user owns or controls, including work computers. (The 5-computer limit is counted within any rolling 12-month period; there is no need to de-register computers after use.)
Multi-user license: A multi-user license is assigned to a named organization and covers a specified number of computers (shown as "Quantity" on the license). It allows use of the product on no more than the specified number of computers within any rolling 30-day period. (Computer installations may be reassigned without a formal de-registration process.)
Revocation
If I determine that a license key has been shared, published, leaked, resold, or otherwise used or distributed beyond the scope permitted by these terms, I may revoke the license. After a license is revoked, you may no longer use the product and I may use technical means to disable the use of the license key.
Update policy
In the first instance, your license entitles you to use the version of the product that existed at the time of purchase. Following your purchase, I may, at my sole discretion, provide updated versions of the product in the future.
Your entitlement to future updates depends on the type of license you have:
Standard License (time-limited): The license period begins on the day of purchase and ends on the expiry date shown in the license details. This license entitles you to use all product updates I release within the license period. Upon expiry, you may continue to use any version of the product released during the license period, but you will need to purchase a new license to receive further updates.
Lifetime License: Entitles you to use all future product updates, without time restriction, for as long as I continue to develop the product.
Charges for additional features
For all types of license, further purchases or subscription payments may be required to access additional features that were not part of the product at the time of purchase.
App Store purchases
From July 2011 to March 2024, PopClip was sold on the App Store. App Store purchases are subject to Apple's standard End User License Agreement (EULA).
App Store migration policy
App Store and license key purchases have separate license agreements for separate editions of the product, and are not transferable between each other. However, as a temporary measure, to ease the move away from the App Store, the Standalone edition of PopClip has recognised App Store purchase receipts and treated them like valid license keys.
Under the terms in force throughout the period of App Store sales, the provision of updates was at my sole discretion, and the App Store purchase terms did not specify any entitlement to future updates. In practice, updates have been provided free of charge to all App Store customers to date.
Starting in July 2026, I am introducing a paid upgrade requirement for older Mac App Store purchases. This is being introduced in stages, beginning with the oldest purchases. PopClip versions released in July 2026 or later treat App Store purchases as follows, depending on the date of purchase:

Where an App Store purchase is no longer recognised, you may continue using the last version of PopClip that accepts your receipt, or obtain a license key to use current versions.
Upgrade offers
Discount offers may be available for App Store customers wishing to buy a license key. To see the current available offer, click the "Upgrade..." button in the Buy pane of PopClip's settings.
Refund policy
Refunds of license key purchases
For license key purchases, you may request a refund from me for 30 days from the date of purchase. You do not need to provide a reason. To request a refund, email me at support@pilotmoon.com, stating your purchase order number and the email address you used for the purchase. I will ask the reseller to send back the money in full. After you receive the refund, your license will be revoked and you may no longer use the product.
You may also have the right to request a refund directly from the reseller, according to the reseller's terms and conditions.
Please try before you buy
I make a loss on all refunds due to transaction fees. Therefore, I ask that you make use of the free trial before buying, and only ask for a refund in exceptional circumstances.
Refunds of App Store purchases
App Store purchases are subject to Apple's refund policies. If you want a refund for your purchase from the App Store, please contact Apple support.
Setapp subscriptions
If you are a subscriber to Setapp, you may use the product as part of your subscription.
Setapp license grant
In consideration of the subscription fees paid by you to Setapp, I grant you a non-exclusive, non-transferable, non-sublicensable, perpetual, irrevocable (subject to your continued payment of the subscription fees when due and payable), royalty-free right and license to use the product subject to these terms and Setapp’s Terms and Conditions.
Extensions
I and others may publish downloadable add-on extensions that add functionality to the product. These extensions are not part of the licensed product and your use of these extensions is not included in these license terms. Extensions are subject to their own license terms as indicated.

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
Changes to these terms
I may update these terms from time to time, and I will publish the latest version here on my website. The terms published at the time of purchase will apply to that purchase.
